Terms and Conditions
Welcome to Funding HQ! We’re glad you’re here. Before you dive into our learning modules, templates, and funder database, we need you to read through and agree to these Terms. We’ve kept the legal jargon to a minimum so it’s clear what you can expect from us — and what we ask of you in return. If anything’s unclear, just get in touch — we’re happy to help.
1. About These Terms
These Terms and Conditions (“Terms”) are our agreement with anyone who uses the Funding HQ website (the “Site”) — whether you’re a first-time visitor, thinking about joining as a Member, one of our consultancy customers, or you’re already a paying Member. By accessing or using the Site in any way, you’re agreeing to these Terms — so please take a moment to read them.
Most of these Terms apply to everyone. A few sections — including Section 4 (Membership Subscriptions), Section 5 (Cancellation & Refunds), and Section 6 (Suspension & Termination) — are specific to paying Members, and won’t apply if you’re just browsing the Site or working with us as a consultancy customer.
If you’re one of our consultancy customers, these Terms cover your use of the Site, but they don’t set out the scope, fees, or deliverables of any consultancy services — we’ll agree those with you directly.
Funding HQ is operated by Funding HQ Platform Ltd, based in New Zealand. If you don’t agree with these Terms, we understand — but we’ll ask that you not use the Site.
2. Eligibility
We want to make sure whoever signs up on behalf of an organisation actually has the green light to do so. By taking out a Funding HQ membership, you’re confirming that you’re authorised to accept these Terms — either for yourself or for the organisation you represent — and that you have the authority to commit that organisation to the obligations that come with membership, including paying the fees.
3. Use of the Site
We want the Site to be a safe, useful place for the whole fundraising community, so we ask that you use it responsibly. That means agreeing not to:
- Break any New Zealand or international law while using the Site
- Try to access parts of the Site or its systems you’re not meant to
- Share anything harmful, offensive, or disruptive
- Use bots or scraping tools to copy or extract our content
4. Membership Subscriptions
4.1 What’s Included
A Funding HQ membership gives your organisation access to:
- Online learning modules covering fundraising skills and strategies
- Downloadable templates for grant applications, donor communications, and fundraising planning
- A curated database of New Zealand funds and funders
- Monthly live webinars on fundraising topics
- A library of recorded webinars from past sessions
We’re always improving our content, so it may change from time to time — we’ll let you know if anything significant shifts. Webinar recordings and live sessions are for your organisation’s own use — please don’t share links, recordings, or logins outside your organisation.
4.2 Subscription Plans
You can subscribe monthly or for a prepaid term, whichever suits you best. Monthly subscriptions run for a minimum term of 6 months from your start date. Prepaid subscriptions are paid in advance for the agreed time period. All prices are in New Zealand Dollars (NZD) and exclude GST where applicable, and you’ll see current pricing on the website.
Unless you cancel in line with Section 5, your subscription will automatically renew at the end of each billing period.
4.3 Invoicing & Payment
For monthly subscriptions, we’ll typically invoice your organisation on the 1st of the month for that month. Please make sure invoices are paid by their due date — timely payment keeps everything running smoothly and helps us avoid any interruption to your access. If a payment is significantly overdue, we may need to suspend your access until it’s resolved (see Section 6).
4.4 Account & Login
A Funding HQ membership belongs to your organisation, not just one person. Your organisation can have up to 5 named users, each with their own unique email address and login. If you need more than 5 users, just get in touch to talk through your options.
Everyone using the membership is responsible for keeping their own login secure and for their own activity on the platform — please don’t share login details between users.
4.5 Restrictions on Use
Membership content — our modules, templates, webinars, and funder database — is for your organisation’s own use. To keep things fair for everyone, please don’t:
- Share, redistribute, or resell content from the platform, including webinar recordings, outside your organisation
- Let people outside your organisation use a login to access the platform
- Use the funder database for anything other than genuine fundraising for your own organisation
5. Cancellation & Refunds
You can cancel your membership at any time, but how that works depends on your subscription type.
Monthly subscriptions run for a minimum term of 6 months. After that, you can cancel by giving us at least 1 month’s written notice — an email to your coach or contact@funding-hq.com is fine. Cancellation takes effect at the end of that notice period, and you’ll keep access until then.
6. Suspension & Termination
We hope we never need to use this section, but if you seriously breach these Terms — say, by sharing your login, misusing the funder database, scraping our content, or falling significantly behind on payment — we may need to suspend or terminate your access, sometimes without notice. Where we can, we’ll let you know why.
If we end your membership because of a breach, we won’t be able to refund any fees you’ve already paid.
7. Intellectual Property
Everything on the Site — our modules, templates, database content, text, and graphics — belongs to Funding HQ or is licensed to us, and it’s protected under New Zealand and international law.
Your membership gives you a personal licence to use this content for your own fundraising work, but it doesn’t transfer any ownership to you.
8. Disclaimer
We put a lot of care into keeping our content accurate and current, but the information, resources, and funder database on Funding HQ are provided for general guidance only. We can’t guarantee they’ll be complete, accurate, or right for your specific situation, and we’re not responsible for funding decisions or outcomes based on what you find on the Site.
9. Customer Stories & Testimonials
From time to time, we share stories, case studies, and testimonials from Members and organisations we’ve worked with, because we think real examples are the best way to show what’s possible. We only publish these with the person or organisation’s permission, and they reflect that individual’s own experience and opinions — they’re not a guarantee that you’ll see the same results. If you’re featured on the Site and would like something updated or removed, just get in touch.
10. Third-Party Links & Services
You’ll sometimes come across links to other websites, funders, or services through the Site and our funder database. These belong to other people, not us, so we can’t vouch for their content or how they operate. Any dealings you have with a third party — including a funder — are between you and them.
11. Limitation of Liability
To the extent the law allows, our liability to you for any claim relating to your use of the Site or membership is limited to the subscription fees you’ve paid us in the 12 months before the claim.
This doesn’t affect any rights you have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other legislation that can’t lawfully be excluded, restricted, or modified.
12. Indemnification
If your breach of these Terms, misuse of our content, or a violation of a law or third party’s rights ends up costing us — through claims, losses, or legal fees — you agree to cover those costs.
13. Force Majeure
Sometimes things happen that are outside our control — internet or hosting outages, natural events, a third-party provider having issues. If that affects our ability to meet our obligations under these Terms, including keeping the Site available, we won’t be held liable for it.
14. Privacy
We take your privacy seriously and handle your personal information in line with the New Zealand Privacy Act 2020 and our Privacy Policy, available at [website link]. By using the Site, you’re agreeing to how we collect and use your information as described there.
15. Changes to These Terms
We may need to update these Terms from time to time. When we do, we’ll post the changes here with a new date. If you keep using the Site after that, we’ll take it that you’re happy with the updated Terms.
16. General
If any part of these Terms turns out to be invalid or unenforceable, the rest will still stand.
These Terms, together with our Privacy Policy, are the whole agreement between you and Funding HQ about your use of the Site and membership — they replace anything agreed before.
You can’t transfer your membership or your rights under these Terms to someone else without our written okay. We may transfer our side of things if we’re ever acquired, merged, or restructured.
17. Governing Law
These Terms are governed by New Zealand law, and any disputes will go through the New Zealand courts.
